A 39-year-old man is due to appear before court soon for allegedly rapping a 12- year -old girl in the border town of Nimule in Eastern Equatoria State.
Advocate Both Philip says the accused he identified as Malaith ATer Achol was arrested on the 10th of October in Nimule town.
Advocate Philip alleges that the suspect called the young to his room and sexually assaulted her.
“This crime occurred in the city of Nimule on the 10th of the month, where this man sexually assaulted this young girl who was 12 years old. This crime is considered a crime against this child and women’s rights.”
According to him, some neighbors who heard the unnamed little girl screaming intervened when they caught the man committing the offense.
Philip says the case under section 247 Penal Code Act 2008, has been transferred to Torit High Court for the trial while the girl is undergoing treatment at the Nimule Civil Hospital.
“The accused is 39 years old. He was arrested and is currently in prison awaiting deportation and trial in the city of Torit before the High Court.”
According to Section 247 of the Penal Code, whosoever has sexual intercourse or carnal intercourse with another person, against his or her will or without his or her consent, commits the offense of rape, and upon conviction, shall be sentenced to imprisonment for a term not exceeding fourteen years and may also be liable to a fine.
